对婚姻家庭编司法解释(二)第五条第二款适用的几点思考

Several Considerations on the Application of the Second Paragraph of Article 5 of the Judicial Interpretation (II) of the Marriage and Family Chapter

摘要: 2025年1月15日，最高人民法院发布《最高人民法院关于适用〈中华人民共和国民法典〉婚姻家庭编的解释(二)》，而本文发现，其中的第五条第二款有突破性规则内容，并不能完全通过《民法典》现有框架加以解释适用，存在较多尚待明确的留白空间，值得深入思考和研究。因此，本文着重对条款中提及的“给予”和“判决该房屋归给予方所有”的内在法律涵义进行分析和研究，以期能够探究出较为明确的裁判规则，并为赠与以及借贷等相关法律行为提供行为依据和指引。

Abstract: On January 15, 2025, the Supreme People’s Court issued the “Interpretation (II) of the Supreme People’s Court on the Application of the Marriage and Family Chapter of the Civil Code of the People’s Republic of China”. This article finds that the second paragraph of Article 5 contains groundbreaking rules that cannot be fully interpreted and applied within the existing framework of the Civil Code. There are still many aspects that need to be clarified, which are worthy of in-depth thinking and research. Therefore, this article focuses on analyzing and studying the internal legal connotations of “giving” and “the judgment that the house belongs to the giver” mentioned in the clause, in the hope of exploring clearer adjudication rules and providing a basis and guidance for related legal acts such as gifts and loans.
