摘要: 网络的普及不仅拓宽了传统犯罪行为的实施范围与手段，还带来了犯罪认定的新挑战。隔空猥亵行为日益猖獗，尽管司法解释已为其定罪提供了依据，但在行为方式、手段强制性、加重情节判断上仍存在认定困境，要解决这些问题，应厘清猥亵罪的保护法益，明确隔空猥亵的行为方式，将犯罪客观行为与被害人心理侵害程度结合起来认定网络猥亵行为的强制性，在解释中明确猥亵概念的核心与外延。

Abstract: The popularity of the Internet has not only broadened the scope and means of committing traditional criminal acts, but also brought new challenges to the identification of crimes. Indecent assault is becoming more and more rampant, although the judicial interpretation has provided the basis for its conviction, but there are still dilemmas in the way of behaviour, means of mandatory, aggravating circumstances judgement, in order to solve these problems, we should clarify the protection of the legal benefits of the crime of indecent assault, clear the way of behaviour of indecent assault in the space, the combination of the objective criminal acts and the degree of psychological infringement of the victim to determine the mandatory network indecent assault, and clarify the core and the extension of the concept of indecent assault in the interpretation.
