电子商务背景下智慧养老服务法律规制研究

A Study on the Legal Regulation of Smart Elderly Care Services in the Context of E-Commerce

摘要: 随着目前我国社会人口老龄化趋势的加剧以及电子商务技术的迭代发展，现如今智慧养老服务模式正在成为满足社会老龄人口对多样化服务需求的重要方式。电子商务平台可以凭借自身优势打破信息壁垒，通过提供养老产品与服务、促进资源流通与整合，强化供给侧结构性改革，为智慧养老的发展持续注入新活力。然而，在电子商务技术支持智慧养老模式快速发展的同时，也暴露出诸如老年人权益保障受损、服务质量缺失监管、数据隐私信息泄露等一系列法律问题。本文以电子商务背景下的智慧养老为研究对象，分析此种模式养老服务的内涵与政策现状，剖析其存在的法律困境与监管漏洞，进而提出针对相关问题与不足的解决方案，以期为推动智慧养老服务的健康发展以及老年人幸福生活的权益保障提供理论支持和实践参考。

Abstract: With the increasing trend of population aging in China and the continuous iteration of e-commerce technologies, the intelligent elderly care service model is becoming an important way to meet the diverse service needs of the elderly population. E-commerce platforms can leverage their advantages to break down information barriers by providing elderly care products and services, promoting the circulation and integration of resources, and strengthening the structural reform of the supply side, thus continuously injecting new vitality into the development of intelligent elderly care. However, while the intelligent elderly care model supported by e-commerce technology is developing rapidly, a series of legal problems have also been exposed, such as the infringement of the rights and interests of the elderly, the lack of supervision over service quality, and the leakage of data privacy information. This paper takes intelligent elderly care under the e-commerce background as the research object, analyzes the connotation and policy status of this elderly care service model, dissects the existing legal difficulties and regulatory loopholes, and then proposes solutions to the relevant problems and deficiencies, in order to provide theoretical support and practical references for promoting the healthy development of intelligent elderly care services and safeguarding the rights and interests of the elderly for a happy life.
