电商平台“先用后付模式”中消费者权益的保护探究

An Exploration of Consumer Rights Protection in the “Use First, Pay Later” Model on E-Commerce Platforms

摘要: 随着数字经济的发展，“先用后付”模式在电商平台广泛兴起，在为消费者带来极大的便利的同时，也为消费者权益的保护带来了新的挑战。由于缺乏相对应的法律法规和行政监管，消费者在面临因“先用后付”模式产生的纠纷时，难以保护自身合法权益。本文揭示消费者在使用“先用后付”模式时所面临的法律风险问题，以及消费者在面临因“先用后付”模式产生纠纷时所面临的维权困境。探究在此类网络交易支付模式中，如何完善消费者权益的保护路径，包括法律法规的细化补充、加强政府部门行政监管、优化消费者维权途径等，旨在构建一个更加健全有效的消费者权益保护体系。

Abstract: With the development of the digital economy, the “use first, pay later” model has widely emerged on e-commerce platforms, bringing great convenience to consumers while also posing new challenges to the protection of consumer rights. Due to the lack of corresponding laws, regulations, and administrative supervision, consumers find it difficult to protect their legitimate rights and interests when facing disputes arising from the “use before pay” model. This article explores the legal risks faced by consumers when using the “use before pay” model, as well as the rights protection dilemma faced by consumers when disputes arise due to the “use before pay” model. It explores how to effectively protect the legitimate rights and interests of consumers in such online transaction payment models, including refining and supplementing laws and regulations, strengthening government supervision, improving information disclosure systems, enhancing platform accountability, and exploring judicial remedies for infringement caused by the “use before pay” model. The aim is to provide effective protection for consumers when facing disputes arising from the “use before pay” model.
