The Improvement of China’s Sound Trademark Registration and Examination System

摘要: 在探讨声音商标注册审查制度时，其核心功能在于评估申请人提交的声音样本是否符合注册为商标的条件。目前我国声音商标的地位有待提高，其显著性的识别主体和识别内容也存在着相应问题，再加上审查资源的有限性，致使我国声音商标注册审查制度举步维艰。本文旨在当前法律框架下，引入公众参与机制，通过制度设计，探索完善声音商标注册审查制度的路径，破解声音商标注册面临的困境。

Abstract: When discussing the sound trademark registration and examination system, its core function is to assess whether the sound sample submitted by the applicant meets the conditions for registration as a trademark. At present, the status of sound trademarks in China needs to be improved, and there are corresponding problems in the identification subject and content of their distinctiveness, coupled with the limited examination resources, which makes it difficult for China’s sound trademark registration and examination system. The purpose of this paper is to introduce a public participation mechanism under the current legal framework, explore the path to improve the sound trademark registration and examination system through system design, and solve the dilemma faced by sound trademark registration.
