电商平台“二选一”垄断现象的反垄断分析与对策
Antitrust Analysis and Countermeasures for the Monopoly Phenomenon of “Choosing One or the Other” on E-Commerce Platforms
摘要: 电商平台“二选一”现象近年来引发广泛关注,本文旨在剖析电商平台“二选一”垄断行为的成因、影响,并提出反垄断对策。首先,本文分析电商平台“二选一”垄断行为的成因,包括市场结构、平台利益驱动、商家困境等。然后,从经济、法律、社会等多维度深入探讨“二选一”垄断行为对市场公平竞争、消费者权益、商家发展的影响。接着,本文研究提出完善法律法规与政策体系、加强监管力度与创新监管方式、促进市场竞争与平台开放、强化平台企业自律与社会责任、推动社会监督与行业自律等反垄断对策。最终,经由理论剖析与实际案例研究证实,这些对策能够有力阻止电商平台实施“二选一”的垄断行为,维护良好的市场秩序,保障消费者与商家的合法权益,推动平台经济稳健前行。
Abstract: The phenomenon of “either-or” choices imposed by e-commerce platforms has attracted widespread attention in recent years. This article aims to analyze the causes and impacts of the monopolistic behavior of “either-or” choices by e-commerce platforms and propose anti-monopoly countermeasures. Firstly, this article examines the causes of the monopolistic behavior of “either-or” choices by e-commerce platforms, including market structure, platform profit motives, and merchant dilemmas. Then, it delves into the impacts of this monopolistic behavior on market fair competition, consumer rights, and merchant development from multiple dimensions such as economy, law, and society. Next, this article proposes anti-monopoly countermeasures such as improving laws, regulations, and policy systems, strengthening regulatory efforts and innovating regulatory approaches, promoting market competition and platform openness, enhancing platform enterprises’ self-discipline and social responsibility, and fostering social and industry self-regulation. Ultimately, through theoretical analysis and practical case studies, it is confirmed that these countermeasures can effectively prevent e-commerce platforms from engaging in the monopolistic behavior of “either-or” choices, maintain a good market order, safeguard the legitimate rights and interests of consumers and merchants, and promote the steady development of the platform economy.
