NFT艺术品的著作权法定位再探讨

Redefining the Dual Nature of NFT Artworks under Copyright Law Frameworks

摘要: “NFT艺术品”的交易是近年来拍卖市场上的热门话题之一。国内目前关于“NFT艺术品”性质及其交易的探讨较少。一些人认为NFT的介入有利于艺术作品知识产权的保护，甚至认为“NFT艺术品”是应受著作权法保护的作品。经由对NFT技术以及对艺术作品NFT化的过程进行分析，结合著作权法的相关规定，本文认为“NFT艺术品”不是作品的一种表现形式，而是一种权利凭证、是原作品著作权商业化的一种形式。“NFT艺术品”应被称为“NFT产品”更为恰当。同时，“NFT艺术品”具有一定的著作权权利属性，可以适用著作权法进行规制。

Abstract: The trading of “NFT artworks” has become one of the most prominent topics in recent art auctions. However, academic discussions on the legal nature of NFT artworks and their transactions remain limited in China. Some scholars argue that the involvement of NFTs facilitates the protection of intellectual property rights in artworks, even asserting that “NFT artworks” qualify as works protected under copyright law. By analyzing NFT technology and the process of converting traditional artworks into NFTs, and drawing upon relevant provisions of copyright law, this paper contends that “NFT artworks” do not constitute a form of expression of the original work, but rather function as certificates of rights and a new mode of commercialization of copyrights. The term “NFT products” would be more accurate in this context. Nevertheless, as NFT artworks embody certain copyright attributes, their transactions may still fall within the regulatory scope of copyright law.
