唐代化外人法律制度研究

Research on the Legal System of Foreigners in the Tang Dynasty

摘要: 对外开放自秦汉以来就是国家治理的一个重要方面，直到唐代，对外的政治、经济、文化等各方面达到了成熟的程度。唐代首创的“化外人”相关法律制度是一大先进之处。但其界定在学界产生了不同的声音，法律制度的梳理也不够全面。本文对“化外人”这一概念进行了界定，并且探讨唐代重视“化外人”立法的原因，分析唐代“化外人”法律规范以及行政管理政策。唐代的立法不仅符合当时社会的发展要求，也顺应了历史发展的潮流，为自身治理奠定基础的同时，更对世界以及后世产生了深远影响。

Abstract: Opening to the outside world has been an important aspect of state governance since the Qin and Han Dynasties. Until the Tang Dynasty, foreign politics, economy, culture and other aspects reached a mature level. The legal system of “foreigner” initiated in the Tang Dynasty was a great advance. However, its definition has produced different voices in academic circles, and the legal system is not comprehensive enough. This paper defines the concept of “foreigner”, discusses the reasons for attaching importance to the legislation of “foreigner” in the Tang Dynasty, and analyzes the legal norms and administrative policies of “foreigner” in the Tang Dynasty. The legislation of the Tang Dynasty not only met the development requirements of the society at that time, but also conformed to the trend of historical development, which laid the foundation for its own governance and had a far-reaching impact on the world and future generations.
