Research on the Protection of Laborers’ Rights and Interests under the Internet Platform

摘要: 互联网平台经济催生的新型用工模式在缓解就业难题的同时，也给劳动者权益保护带来新挑战。本研究聚焦于互联网经济平台工作的劳动者权益保护问题，深入剖析其劳动权利状况及面临的挑战。文章开篇阐述了互联网平台劳动者权益保护相关概念，包括平台及劳动者的定义；继而分析了互联网平台经济下劳动者权益保障存在的问题，涵盖劳动关系认定、社会保险、工作时间与条件、劳动收入等方面；最后针对性地提出完善建议，涉及完善劳动关系认定标准、社保机制，加强工会参与、平台企业监督，以及强化劳动者法律维权认知等内容。

Abstract: The new employment mode promoted by the Internet platform economy not only relieves the employment problem, but also presents novel challenges for safeguarding workers’ rights and interests. This research centers on the protection of rights and interests for workers engaged in the Internet economic platform and deeply analyzes their labor rights and challenges. In the beginning, the article expounds on the notions associated with the safeguarding of workers’ rights and interests in internet platforms, including the definition of platform and workers. Then, it probes into the issues present in the safeguarding of workers’ rights and interests under the Internet platform economy, including the identification of labor relations, social insurance, working hours and conditions, labor income and so on. Finally, the paper puts forward some suggestions for improvement, including improving the standards of labor relations identification, social security mechanism, strengthening trade union participation, platform enterprise supervision, and strengthening workers’ awareness of legal rights protection.
