电商外卖平台“影子厨房”乱象的法律规制研究
Research on the Legal Regulation of the “Shadow Kitchen” Chaos of the Takeaway Platform
摘要: 随着电商经济的快速发展,“线上订购 + 线下配送”的外卖方式既省时又便捷,成为快节奏生活的不二选择,各大网络平台也纷纷推出外卖服务。然而,外卖平台“影子厨房”乱象日益突出,表现为无实体门店、套用证照或虚拟注册等违规经营形式,严重威胁食品安全与消费者权益。因此,本文围绕“影子厨房”乱象,分析其成因及引发的法律风险,提出了建立联合监管机制、强化事中监管措施以及完善事后追责体系等规制路径,旨在构建一个更加透明、规范、安全的外卖市场环境。
Abstract: With the rapid development of e-commerce economy, the takeaway mode of “online ordering + offline distribution” is time-saving and convenient, and has become the only choice for fast-paced life. Major network platforms have also launched takeaway services. However, the chaos of the takeaway platform’s “shadow kitchen” has become increasingly prominent, which is manifested in illegal business forms such as no physical stores, licenses or virtual registration, which seriously threatens food safety and consumer rights. Therefore, this paper focuses on the “shadow kitchen” chaos, analyzes its causes and legal risks, and puts forward regulatory paths such as establishing a joint supervision mechanism, strengthening the in-process supervision measures, and improving the post-accountability system, aiming to build a more transparent, standardized and safe takeaway market environment.
