国际数字服务贸易下欧盟《数字服务法》超大型在线平台监管规则研究

Research on the Supervision Rules of EU’s “Digital Services Act” Super Large Online Platform under the International Digital Services Trade

摘要: 欧盟《数字服务法》构建了全球数字平台监管的“黄金标准”，其针对超大型在线平台的差异化监管框架，对全球数字治理格局产生深远影响。文章深入剖析欧盟《数字服务法》超大型在线平台的关键监管条例，分析了平台需履行的内部治理责任，以及监管机构应承担的监督职能等内容，并结合欧盟执法实践分析其初步成效与挑战。在此基础上，深入探讨中国可借鉴之处，立足本土数字生态特点，平衡安全与发展，探索具有中国特色的数字平台治理道路，为构建安全、可信、创新的数字空间贡献中国智慧。

Abstract: The “Digital Services Act” of the European Union has established the “gold standard” for global digital platform supervision, and its differentiated supervision framework for super-large online platforms has a far-reaching impact on the global digital governance pattern. This paper deeply analyzes the key regulatory regulations of the European Union’s “Digital Services Act” on super-large online platforms, analyzes the internal governance responsibilities that the platform needs to perform, and the supervisory functions that the regulatory agencies should undertake, and analyzes its initial achievements and challenges in combination with EU law enforcement practice. On this basis, we will deeply explore what China can learn from, balance security and development based on the characteristics of local digital ecology, explore the governance road of digital platform with Chinese characteristics, and contribute Chinese wisdom to building a safe, credible, and innovative digital space.
