Exploring the Dilemmas and Legal Countermeasures for Protecting the Homestead Use Rights of Rural Women

摘要: 在农村土地制度改革持续推进的背景下，农村女性宅基地使用权保障问题愈发凸显其重要性与紧迫性。本文聚焦农村女性这一特殊群体，深入剖析其在宅基地使用权保障方面面临的现实困境，涵盖法律规范模糊、传统习俗制约、权益救济途径不畅等方面。通过对现有法律体系与实际执行情况的系统分析，揭示出制度设计与实践操作中存在的诸多问题。最后，从完善法律制度、强化执法监管、优化权益救济机制等维度提出针对性的法律对策，以期为农村女性宅基地使用权的有效保障提供理论参考与实践指导，推动农村土地权益分配的公平与正义。

Abstract: With the continuous advancement of rural land system reform, the protection of rural women’s homestead use rights has emerged as an issue of growing importance and urgency. This paper focuses on rural women as a specific group, deeply analyzing the practical dilemmas they face in safeguarding homestead use rights. These dilemmas include vague legal norms, constraints from traditional customs, and inadequate channels for rights relief. Through a systematic analysis of the existing legal framework and its practical implementation, this study reveals numerous issues in both institutional design and operational practice. Finally, this paper proposes targeted legal countermeasures from multiple dimensions, including improving the legal system, strengthening law enforcement and supervision, and optimizing the rights relief mechanism. The aim is to provide theoretical references and practical guidance for the effective protection of rural women’s homestead use rights, and to promote fairness and justice in the distribution of rural land rights and interests.
