仅退款规则存在的法律思考

摘要: 仅退款规则从被推出以来一直备受争论,原因在于引起了不少的信息网络购物纠纷。该规则初衷是对消费者权益的保护,但是其固有的漏洞使得规则在运行中无形滋长了不良的购物行为。首先介绍正常的维权和不良仅退款行为的表现,分析其隐蔽性、利用规则漏洞、目的不正当性等特点。接着讨论司法实践中裁判现状与存在的问题,如平台对不良仅退款的包容、维权与恶意行为的界限模糊等。其次,从民法角度分析了仅退款规则,指出其可能加重商家责任、限制权利的问题。最后再结合现在电商平台取消仅退款的风向,指出不良仅退款行为的法律责任,并给出如何平衡消费者权益和商家的权益平衡的对策建议,包括平台规则优化、消费者引导、商家权益申诉程序完善和法律制度健全。
Abstract: Since the rule of Refund-Only has been created to protect consumer, it triggered widespread debate. Because this rule’s bug, leading a fraudulent shopping activities with it’s operation. Now, this paper wants to explain the difference between normal shopping activities and fraudulent shopping activities, exhibits characteristics such as concealment, exploring of rule vulnerabilities, and illegitimate intent. Then, discussing the realities and challenges in judicial decision-making in practice, showing it’s deficiencies. Secondly, from a civil law perspective, the “refund-only” rule was analyzed, pointing out issues such as potential increase in merchant liability and restriction of rights. Finally, considering the current trend of e-commerce platforms abolishing the “refund-only” policy, the legal responsibilities of abusive refund-only behaviors were discussed. Suggestions were provided on how to balance consumer rights and merchant interests, including platform rule optimization, consumer guidance, improvement of merchant rights appeal procedures, and enhancement of legal systems.
