电子商务平台审核及安全保障义务的失衡性研究

Research on the Imbalance of Review and Security Assurance Obligations of E-Commerce Platforms

摘要: 近年来，电商领域产品安全事故频发，平台经营者对自身审核义务与安全保障义务的履行质量愈发关键。本文通过对电商平台审核及安全保障义务法理基础的界定，系统探讨了电商平台审核及安全保障义务的履行现状，揭示出二者在实践中存在的多重失衡性表现，包括审核形式化与安全保障滞后、商业利益优先与义务履行弱化、责任划分模糊与消费者救济不足等问题。针对这些失衡，文章从全流程审核机制构建、风险预警与救助机制升级、考核体系优化及多主体协同监管等方面提出了针对性优化措施，以期为平台完善相关流程和机制提供指引，推动义务履行机制完善。

Abstract: In recent years, product safety incidents in the e-commerce sector have occurred frequently, making the quality of platform operators’ fulfillment of their review and security obligations increasingly crucial. This article defines the legal basis of the review and security obligations of e-commerce platforms, systematically explores the current status of their fulfillment, and reveals multiple imbalances in practice, including formalized reviews and lagging security measures, prioritization of commercial interests over obligation fulfillment, ambiguous responsibility allocation, and insufficient consumer remedies. In response to these imbalances, the article proposes targeted optimization measures from aspects such as the construction of a full-process review mechanism, upgrading of risk warning and rescue mechanisms, optimization of assessment systems, and multi-party collaborative supervision, with the aim of providing guidance for platforms to improve their relevant processes and mechanisms and promote the improvement of obligation fulfillment mechanisms.
