跨境电子商务平台在线纠纷解决机制管辖权问题研究

Research on Jurisdiction Issues of Online Dispute Resolution of Cross-Border E-Commerce Platforms

摘要: 贸易全球化以及互联网蓬勃发展的大背景下，跨境电子商务平台与日俱增，阿里巴巴国际站等跨境电子商务平台俨然成为了跨境贸易的优先选择。在享受技术进步的同时，也无从回避其引发的挑战与冲突。突破传统的跨国诉讼与国际仲裁在空间与时间上的限制，能够高效、便捷在线解决问题的在线纠纷解决机制(Online Dispute Resolution，简称“ODR”)应运而生。然而，平台ODR的管辖权条款设计权掌握在各平台自身手中，其机制的合法性与有效性尚存疑问。鉴于此，本文旨在剖析跨境电子商务平台ODR的管辖权条款存在的问题，参考相关法律规范与规则实践，探索完善我国跨境纠纷解决的有效路径。

Abstract: As trade globalization and the rapid development of the Internet continue to flourish, cross-border e-commerce platforms such as Alibaba.com have increasingly become the preferred choice for international trade. While benefiting from technological advancements, the challenges and conflicts arising from this progress cannot be overlooked. To overcome the spatial and temporal limitations of traditional cross-border litigation and international arbitration, Online Dispute Resolution (ODR) has emerged as an efficient and convenient mechanism for resolving disputes online. However, the design of jurisdiction clauses in platform ODR remains under the control of the platforms themselves, raising questions about the legitimacy and effectiveness of such mechanisms. In light of this, this paper aims to analyze the jurisdiction clauses in ODR mechanisms of cross-border e-commerce platforms, drawing on relevant legal norms and practical rules, to explore effective pathways for improving the resolution of cross-border disputes in China.
