美术作品实质性相似的认定——以某著作权侵权纠纷案为例
Recognition of Substantial Similarity of Works of Art—Taking a Copyright Infringement Dispute as an Example
摘要: 自从我国1990年第一部《著作权法》颁布至今三十几年以来,关于美术作品侵权的案件时有发生。通过对具体案例的案情以及一、二审法院裁判进行简述的基础之上,深入剖析实质性相似的法律属性、判定前提、判定规则以及美术作品实质性相似判断的特殊性,最后基于上述探讨,提出了美术作品实质性相似判断的建议,提出界定独创性表达和排除不受保护内容的建议,旨在为美术作品著作权保护及相关司法实践提供一点参考,以此维护创作者的合法权益,促进美术创作的健康发展。
Abstract: Since the promulgation of the first “Copyright Law” in 1990, there have been many cases of infringement of art works. Based on the brief introduction of the facts of specific cases and the judgments of the courts of first and second instance, this paper deeply analyzes the legal attribute, judgment premise, judgment rules of substantive similarity and the particularity of substantive similarity judgment of fine art works. Finally, based on the above discussion, this paper puts forward suggestions on substantive similarity judgment of fine art works. The suggestion of defining original expression and excluding unprotected content is put forward to provide some reference for copyright protection of fine art works and related judicial practice, so as to safeguard the legitimate rights and interests of creators and promote the healthy development of fine art creation.
