电商平台自治权的边界限制研究——基于《电子商务法》框架下的理论与实践探索

摘要: 随着平台经济的快速发展，平台依托规则、算法形成的自治权的限制与监管成为数字经济法治化治理的核心议题。现有制度在平台自治权规制上存在实践困境，需从理论层面明确其属性定位，并构建科学的边界认定体系。本文围绕平台自治权的特殊性，结合国内实践现状，从多维度探索平台自治权边界不明因素引发的实践困境及完善路径，将平台自治权放在法律框架下动态调适，平衡创新活力与公共利益。通过协同治理思路与制度创新，可为平台经济法治建设提供参考，推动法律与技术协同适配，实现平台自治与经营者、用户的良性互动，助力平台经济高质量发展。

Abstract: With the rapid development of platform economy, the restriction and supervision of the autonomy formed by platform relying on rules and algorithms has become the core issue of the rule-based governance of digital economy. There are practical difficulties in the regulation of platform autonomy in the existing system, so it is necessary to clarify its attribute orientation from the theoretical level and build a scientific boundary identification system. Focusing on the particularity of platform autonomy, combined with the current situation of domestic practice, this paper explores the practical dilemma and improvement path caused by the unclear boundary of platform autonomy from multiple dimensions, dynamically adjusts the platform autonomy under the legal framework, and balances the innovation vitality and public interests. Through collaborative governance ideas and institutional innovation, it can provide reference for the rule of law construction of platform economy, promote the coordinated adaptation of law and technology, realize the benign interaction between platform autonomy and operators and users, and help the high-quality development of platform economy.
