The Protection of Consumers’ Right to Know in Online Shopping
摘要: 伴随着5G信息技术、人工智能、大数据的飞速发展,网络购物已经全面跃升为当下消费领域的主流模式,但其虚拟化、跨区域性等特征也使得消费者知情权的保护面临诸多挑战。本文以网络购物中消费者知情权为研究对象,首先界定网络购物的含义与特征,明确其在交易环境、成本结构及参与主体方面与传统购物的差异;其次,系统整理我国网络消费者知情权法律制度体系,重点分析《消费者权益保护法》《电子商务法》及《网络交易监督管理办法》等法律法规中关于信息披露、平台责任的核心条款,剖析当前法律框架的优势与不足;再次,从信息披露不完备、平台监管责任落实不到位、司法救济途径繁琐及跨区域跨部门治理力度不足四个维度,深入探讨网络消费者知情权受侵害的主要表现及成因;最后,结合我国国情并借鉴欧盟等地区的经验,提出完善网络消费信息披露制度、建立高效专业监管机构、拓宽司法救济途径及强化跨区域跨部门协同治理的对策建议。这篇论文的研究目的是为优化当前网络消费环境、健全消费者权益保护机制提供参考,助力网络交易市场的健康有序发展。
Abstract: With the rapid development of 5G information technology, artificial intelligence and big data, online shopping has fully become the mainstream mode in the current consumption field. However, its virtual nature and cross-regional characteristics also pose numerous challenges to the protection of consumers’ right to know. This paper takes the right to know of online consumers as the research object. Firstly, it defines the meaning and characteristics of online shopping, clarifying the differences between it and traditional shopping in terms of transaction environment, cost structure, and participating subjects. Secondly, it systematically sorts out the legal system for the right to know of online consumers in China, focusing on analyzing the core provisions regarding information disclosure and platform responsibility in laws and regulations such as the “Consumer Rights and Interests Protection Law”, the “E-commerce Law”, and the “Measures for the Supervision and Administration of Online Transactions”, and dissecting the advantages and disadvantages of the current legal framework. Thirdly, it deeply explores the main manifestations and causes of the infringement of the right to know of online consumers from four dimensions: incomplete information disclosure, inadequate implementation of platform regulatory responsibilities, cumbersome judicial relief channels, and insufficient cross-regional and cross-departmental governance efforts. Finally, based on China’s national conditions and drawing on the experiences of regions such as the European Union, it proposes countermeasures and suggestions for improving the online consumption information disclosure system, establishing efficient and professional regulatory institutions, broadening judicial relief channels, and strengthening cross-regional and cross-departmental collaborative governance. The purpose of this paper is to provide references for optimizing the current online consumption environment and improving the consumer rights protection mechanism, and to contribute to the healthy and orderly development of the online transaction market.
