摘要: 渔业水产种质资源保护是一项长期而艰巨的系统工程，法律作为其中的核心保障力量，其完善与有效实施至关重要。首先阐述了水产种质资源的概念、价值，强调其作为渔业可持续发展物质基础和水域生态系统稳定核心要素的重要性，以及保护的必要性。接着梳理我国已构建的多层次水产种质资源保护法律体系，通过正视当前法律体系存在的漏洞、执法监管困境及地方性法规配套不足等问题，针对性地健全法律制度、强化执法监管、完善地方性法规与协调区域差异，构建全方位、多层次的法律保护网络，才能切实守护好我国宝贵的渔业水产种质资源，为渔业可持续发展提供坚实基础，促进渔业经济与生态环境协同演化，推动水产种质资源在法治框架下实现代际公平与可持续利用。

Abstract: The protection of fishery and aquatic germplasm resources is a long-term and arduous systematic project. As the core guarantee force within it, the improvement and effective implementation of laws are of vital importance. Firstly, the concept and value of aquatic germplasm resources were expounded, emphasizing their significance as the material basis for the sustainable development of fishery and the core element for the stability of aquatic ecosystems, as well as the necessity of protection. Next, we will sort out the multi-level legal system for the protection of aquatic germplasm resources that has been established in our country. By facing up to the existing loopholes in the current legal system, the predicament of law enforcement and supervision, and the insufficiency of local regulations, we will specifically improve the legal system, strengthen law enforcement and supervision, perfect local regulations and coordinate regional differences, and build a comprehensive and multi-level legal protection network. Only in this way can we effectively safeguard our country’s precious fishery and aquatic germplasm resources, provide a solid foundation for the sustainable development of fishery, promote the coordinated evolution of fishery economy and ecological environment, and ensure the intergenerational equity and sustainable utilization of aquatic germplasm resources within the framework of the rule of law.
