摘要: 随着网络技术的不断发展，二次创作短视频应运而生，它已经成为人们表达情感和与他人交流的主要方式。但是，对于他人原创作品的使用行为是否构成侵权问题引发了广泛争议，挑战了现行的合理使用制度在法律适用方面的认定。因此本文从二次创作短视频的侵权现状出发，厘清二次创作短视频判定侵权过程中的“实质性相似”、“合理使用制度”的相关内容，从而探索出我国二次创作短视频著作权侵权判定的完善路径，促进二次创作短视频行业的健康发展。

Abstract: With the continuous development of network technology, secondary creation of short videos has emerged, which has become the main way for people to express emotions and communicate with others. However, the issue of whether the use of original works by others constitutes infringement has sparked widespread controversy, challenging the current system of fair use in determining legal application. Therefore, this article starts from the current situation of infringement of secondary creation short videos, clarifies the relevant content of “substantial similarity” and “reasonable use system” in the process of determining infringement of secondary creation short videos, and explores the improvement path of copyright infringement determination of secondary creation short videos in China, promoting the healthy development of the secondary creation short video industry.
