摘要: 人工智能审判的正当性主要包括审判正当性、推理正当性、程序正当性三个重要部分，是其能否融入到司法审判领域的关键。以司法实践的成果来看，当前的司法人工智能能给司法审判提供极大的便利，所以比起可行性问题，更应当关注司法人工智能参与审判的正当性问题。从当今的时代背景来看，人工智能参与到司法审判中来已经是必然趋势。因此，对人工智能审判的正当性进行研究将会从法理层面为新兴科技在审判实践中的合理运用提供理论依据。

Abstract: The legitimacy of artificial intelligence trials mainly includes three important parts: trial legitimacy, reasoning legitimacy, and procedural legitimacy. These are keys to whether it can be integrated into the judicial trial field. From the perspective of achievements in judicial practice, current judicial AI can provide significant convenience for judicial trials. Therefore, rather than focusing on the issue of feasibility, greater attention should be paid to the legitimacy of AI’s participation in judicial trials. Against the backdrop of the current era, the involvement of AI in judicial trials has become an inevitable trend. Consequently, researching the legitimacy of AI in judicial trials will provide a theoretical basis from the perspective of jurisprudence for the rational application of emerging technologies in trial practice.
