电商平台ODR决议执行机制研究

Research on the Implementation Mechanism of ODR Resolution on E-Commerce Platforms

摘要: 随着数字经济的蓬勃发展，电商平台已成为社会消费的重要载体。交易量的急剧增长带来了纠纷数量的上升，传统线下调解与诉讼机制难以满足效率与成本的双重要求。ODR作为互联网时代的新型纠纷处理机制正在成为电商治理的重要组成部分。然而，当前电商平台的ODR实践仍存在执行力不足、法律效力不明、平台自治与司法衔接不畅等问题。当前需从电商经济发展的现实需求出发，分析ODR机制的运行逻辑与执行困境，提出构建中国电商平台ODR决议执行机制的路径建议，以期推动数字经济治理体系的现代化。

Abstract: With the booming development of the digital economy, e-commerce platforms have become an important carrier of social consumption. The sharp increase in transaction volume has led to an increase in the number of disputes, and traditional offline mediation and litigation mechanisms are unable to meet the dual requirements of efficiency and cost. As a new dispute resolution mechanism in the Internet era, ODR is becoming an important part of e-commerce governance. However, the current ODR practices of e-commerce platforms still face problems such as insufficient execution, unclear legal effectiveness, and poor connection between platform autonomy and judiciary. Starting from the practical needs of the development of e-commerce economy, it is necessary to analyze the operational logic and execution difficulties of the ODR mechanism, and propose path suggestions for building an ODR resolution execution mechanism for Chinese e-commerce platforms, in order to promote the modernization of the digital economy governance system.
