电子商务“虚拟财产”交易纠纷的法律适用——以网络店铺转让为例

The Application of Law in Disputes over the Transactions of “Virtual Property” in E-Commerce—Taking the Transfer of Online Stores as an Example

摘要: 随着互联网技术的飞速发展，电子商务已成为现代经济的重要组成部分，而虚拟财产作为数字化经济中的新型资产，逐渐吸引了越来越多的关注。网络店铺作为虚拟财产的典型表现，其转让过程中涉及的法律适用问题日益突出，成为学术界和司法实践的重要研究课题。本文以“网络店铺转让”为切入点，分析了我国目前虚拟财产在法律适用中的主要问题，探讨了网络店铺转让过程中合同效力认定、平台责任、虚拟财产权属归属等核心法律问题，并提出了完善我国虚拟财产法律体系的建议。研究表明，当前我国关于虚拟财产的立法尚不完善，司法适用中存在较大不确定性，平台在交易管理中的责任尚未得到充分明确。通过完善虚拟财产的法律地位、建立虚拟财产交易公示与备案制度、强化平台的法律责任及完善纠纷解决机制等措施，可以有效规范网络店铺转让交易，推动虚拟财产市场的健康发展。

Abstract: With the rapid development of internet technology, e-commerce has become an important part of modern economy, and virtual property, as a new type of asset in the digital economy, has gradually attracted more and more attention. As a typical manifestation of virtual property, the transfer process of online stores involves increasingly prominent legal application issues, which have become important research topics in the academic community and judicial practice. This article takes “the transfer of online stores” as the entry point, analyzes the main problems in the legal application of virtual property in China at present, discusses core legal issues such as the determination of contract validity, platform liability, and the ownership of virtual property during the transfer of online stores, and proposes suggestions for improving the legal system of virtual property in China. Research shows that the current legislation on virtual property in China is not yet complete, there is significant uncertainty in judicial application, and the responsibility of platforms in transaction management has not been fully clarified. By improving the legal status of virtual property, establishing a virtual property transaction public announcement and filing system, strengthening the legal responsibility of platforms, and improving the dispute resolution mechanism and so on. It is possible to effectively regulate the transfer transactions of online stores and promote the healthy development of the virtual property market.
