“小程序”电商平台的法律义务配置研究
Research on the Configuration of Legal Obligations for “Mini-Program” E-Commerce Platforms
摘要: 在实践层面,小程序电商交易规模巨大且持续高速增长,但相关的法律争议频发,本研究直面这一热点问题,为司法实践和监管政策提供了清晰的分析框架和解决方案,有助于保护消费者权益、规范市场秩序。在理论层面,文章的创新性主要体现在其构建的“三维义务体系”,该体系没有停留在对现有法律的简单解读,而是结合小程序电商的独特业态,创造性地将平台义务分解为“基础共性”、“类型化差异”和“特殊场景”三个维度,提供了一种比传统“一刀切”模式更为精准、动态的规制思路,深化了平台责任理论在特定场景下的应用。
Abstract: At the practical level, the transaction scale of mini-program e-commerce is huge and maintains rapid growth, yet relevant legal disputes occur frequently. This research directly addresses this hot issue, providing a clear analytical framework and solutions for judicial practice and regulatory policies, which is conducive to protecting consumers’ rights and interests and regulating market order. At the theoretical level, the innovation of this paper is mainly reflected in the construction of a “three-dimensional obligation system”. Instead of merely interpreting existing laws, this system creatively decomposes platform obligations into three dimensions—"basic commonalities”, “typed differences”, and “special scenarios”—by combining the unique business format of mini-program e-commerce. It provides a more precise and dynamic regulatory approach than the traditional “one-size-fits-all” model, deepening the application of platform liability theory in specific scenarios.
