电商经济背景下平台虚假宣传问题的法律适用研究

摘要: 随着互联网技术的迅猛发展,电商经济已成为社会经济中的重要组成部分,但随之而来的虚假宣传问题亦不可避免,且电商平台虚假宣传影响消费者合法权益。首先,基于对实践中电商平台突显的主要问题的分析,可以明确的是电商平台虚假宣传形式复杂多样且监管力度不足,以及其责任认定仍具有模糊性。其次,对电商平台虚假宣传的法律适用困境进行厘清。最后,提出相应的法律建议和对策。对电商平台虚假宣传的法律适用和综合治理,唯有通过完善现有的法律体系、明确平台的审查责任和加强消费者权益保障等从多个层面入手,才能形成一个健全的法律监管体系,为电商平台和电商经济的健康发展,以及消费者权益的保护,提供更加坚实的法律保障。
Abstract: With the rapid development of Internet technology, e-commerce economy has become an important part of social economy, but the problem of false propaganda is inevitable, and the false propaganda of e-commerce platform affects the legitimate rights and interests of consumers. First of all, based on the analysis of the main problems highlighted by the e-commerce platform in practice, it is clear that the false propaganda forms of the e-commerce platform are complex and diverse and the supervision is insufficient, and its responsibility identification is still ambiguous. Secondly, it clarifies the legal application dilemma of false publicity on e-commerce platforms. Finally, it puts forward the corresponding legal advice and countermeasures. To effectively address the legal application and comprehensive governance of false advertising on e-commerce platforms, only by perfecting the existing legal system, clarifying the review responsibility of the platform and strengthening the protection of consumers’ rights and interests, can a sound legal supervision system be formed. For the healthy development of e-commerce platform and e-commerce economy, it has provided more solid legal protection for the protection of consumers’ rights and interests.
