摘要: 当今时代，互联网的快速发展使得网络暴力事件层出不穷，对社会造成了极为恶劣的影响，然而现实中针对网络暴力行为的民事诉讼存在着诸如证据收集困难、维权成本大、侵权主体难以明确等多方面的困境。因此，剖析这些问题的产生原因并提供切实可行的应对办法，是有效治理网络暴力问题、保障社会稳定性的必要要求。本文将紧扣网络暴力这个社会治理热点问题，从相关概念出发，多个角度深入分析网络暴力行为治理背后的法律规制缺失，重点探究侵权行为和民事诉讼维权过程中存在的现实问题并提供解决方案，打击侵权行为，维护网络空间的和谐生态。

Abstract: In the current era, the rapid development of the Internet has led to an incessant emergence of cyberbullying incidents, exerting an extremely negative impact on society. However, in practice, civil litigation against cyberbullying faces multiple challenges, such as difficulties in evidence collection, high costs of rights protection, and the difficulty in identifying the liable parties. Therefore, analyzing the causes of these problems and providing practical solutions are essential for effectively governing cyberbullying and ensuring social stability. This paper focuses on the hotspot social governance issue of cyberbullying. Starting from related concepts, it conducts an in-depth analysis of the deficiencies in the legal regulations underlying the governance of cyberbullying from multiple perspectives. It particularly explores the practical problems existing in the process of addressing infringements and pursuing rights protection through civil litigation, proposes corresponding solutions, and aims to combat infringements, thereby maintaining a harmonious ecology in cyberspace.
