我国犯罪构成理论的思考

Reflections on the Theory of Criminal Constitutions in China

摘要: 犯罪构成理论，对于刑法学的发展作用及意义是不言而喻的。随着时代的发展，我国犯罪构成四要件理论固有的缺陷逐渐显露，而三阶层理论的引入更是让传统理论迎来真正的挑战，故学界一直存在“移植说”与“肯定说”两种对立观点。本文梳理了犯罪构成理论不同的学术观点、争论分歧，分析了三阶层犯罪构成理论的优越性，表明我们应当正确认识不同理论的优缺点，进行合理的借鉴与移植，努力构建具有中国特色的犯罪构成理论。

Abstract: The theory of criminal composition plays an undeniable role and significance in the development of criminal law. However, with the progress of the times, the inherent flaws of the four-element theory in China gradually emerged, and the introduction of the three-tier theory posed a genuine challenge to the traditional theory. As a result, there have always been two opposing viewpoints in academia: the “transplantation theory” and the “affirmation theory.” This paper reviews the different academic perspectives and disputes on the theory of criminal composition, analyzes the advantages of the three-tier theory of criminal composition, and indicates that we should correctly recognize the strengths and weaknesses of different theories, make reasonable references and transplants, and strive to construct a theory of criminal composition with Chinese characteristics.
