中国国际教育服务贸易法律问题研究

Research on Legal Issues in China’s International Education Service Trade

摘要: 《服务贸易总协定》(GATS)明确规定国际教育服务贸易为国际服务贸易的一部分，为其提供了国际法的规范。随着全球教育服务市场的不断扩大，国际教育服务贸易已成为各国提升软实力与竞争力的重要领域。与此同时，中国在教育服务贸易领域也迅速发展、逐渐成熟，但伴随着发展机遇而来的法律与政策层面的挑战也限制着我国国际教育服务长久且深远的发展。本研究基于WTO/GATS框架，系统梳理中国在国际教育服务贸易领域的入世承诺，分析其相关法律体系的现状与存在的问题，并结合中国国情对国际教育服务贸易法律制度提出完善建议，为我国国际教育服务贸易提供有法律保障的国际竞争力。

Abstract: “The General Agreement on Trade in Services” (GATS) explicitly stipulates that international education service trade is part of international trade in services, providing it with regulation under international law. With the continuous expansion of the global education services market, international education service trade has become an important field for countries to enhance their soft power and competitiveness. At the same time, China has rapidly developed and gradually matured in the field of education service trade. However, legal and policy challenges accompanying these development opportunities have also limited the long-term and profound development of China’s international education services. This study, based on the WTO/GATS framework, systematically reviews China’s commitments in the field of international education service trade, analyzes the current status and problems of its related legal system, and, considering China’s national conditions, proposes improvements to the legal system for international education service trade, providing China with legally supported international competitiveness in this field.
