网络虚拟财产的继承问题探析

An Analysis of the Inheritance of Online Virtual Property

摘要: 互联网技术拉近虚拟财产与日常生活的距离，网络用户老龄化使得虚拟财产继承日益成为人们的关注焦点。我国《民法典》将网络虚拟财产确立为民法保护对象，但虚拟财产保护和继承的具体规则处于缺失状态，使得实践中具体案件缺少法律遵循。本文系统分析网络虚拟财产继承存在的问题：规范缺失使得继承主体、客体和程序不明确；网络服务协议对继承权利进行限制和排除，并有针对性的提出合理建议。本文认为，虚拟财产具有继承必要性，立法须回应社会需要，通过具体规则明确继承主体、客体和程序。根据服务商提请注意义务等的履行情况和公平原则确定网络服务协议的内容和条款效力，以规范不当限制用户权利的网络服务协议。

Abstract: Internet technology has shortened the distance between virtual property and daily life, and the aging of Internet users has made the inheritance of virtual property increasingly the focus of people’s attention. Chinese “Civil Code” establishes online virtual property as the object of civil law protection, but the specific rules of virtual property protection and inheritance are in a state of lack, which makes specific cases lack legal compliance in practice. This paper systematically analyzes the issues surrounding the inheritance of online virtual property: the lack of norms makes the subject, object and procedure of inheritance unclear; the network service agreement restricts and excludes inheritance rights, and reasonable suggestions are made in a targeted manner. This paper believes that virtual property has the necessity of inheritance, and legislation must respond to social needs, and specify the subject, object and procedure of inheritance through specific rules. According to the performance of the service provider’s duty of attention and the principle of fairness, the content and terms of the network service agreement are determined to regulate the network service agreement that improperly restricts the rights of users.
