银发经济背景下老年人消费权益的法律保障研究
Legal Protection of Elderly Consumers’ Rights and Interests in the Context of the Silver Economy
摘要: 随着银发经济蓬勃发展,老年人消费市场日益扩大,但针对老年人的消费欺诈行为也呈现多样化、隐蔽化、线上线下融合化趋势,严重侵害老年人财产权益与身心健康,破坏市场秩序。当前我国老年人消费欺诈法律规制体系虽已初步建立,但在立法针对性、监管效能、维权机制等方面仍存在短板。本文通过分析老年人消费欺诈的表现形式与法律规制现状,剖析现行制度存在的不足及成因,从立法完善、监管强化、维权保障、社会共治四个维度提出优化路径,为构建全链条、多层次的老年人消费权益保护体系提供参考,助力银发经济健康发展。
Abstract: With the vigorous development of the silver economy, the elderly consumer market has expanded increasingly. However, consumer fraud targeting the elderly has shown a trend of diversification, concealment, and integration of online and offline modes, which seriously infringes on the property rights, interests, and physical and mental health of the elderly, and disrupts the market order. Although China has initially established a legal regulation system for consumer fraud against the elderly, there are still shortcomings in terms of legislative pertinence, regulatory efficiency, and rights protection mechanisms. By analyzing the manifestations and current status of legal regulation of consumer fraud against the elderly, this paper explores the deficiencies and causes of the existing system, and proposes optimization paths from four dimensions: legislative improvement, regulatory strengthening, rights protection guarantee, and social co-governance. It provides references for building a full-chain and multi-level protection system for the elderly’s consumer rights and interests, and contributes to the healthy development of the silver economy.
