银发经济高质量发展背景下老年人数字权益的法治保障研究

摘要: 在人口老龄化与数字化交汇的时代背景下，老年人数字权益保障成为彰显数字正义、推进法治中国建设的重要命题。当前，老年人数字权益保护面临立法不健全、数字鸿沟阻隔、救济机制低效等现实困境，制约其平等共享数字化发展成果。为此，需从老年人数字权益的复合属性出发，通过完善专项立法、强化监管协同、健全多元救济机制、提升老龄群体数字素养，构建全方位法治保障体系，实现银发经济高质量发展与老年人数字权益保护的双向赋能，彰显中国式现代化的民生温度。

Abstract: Against the backdrop of the intersection of population aging and digitalization, the protection of the digital rights and interests of the elderly has become a crucial proposition for embodying digital justice and advancing the construction of a rule-of-law China. At present, the protection of the elderly’s digital rights and interests is confronted with practical predicaments such as inadequate legislation, the digital gap, and inefficient remedy mechanisms, which restrict their equal sharing of the fruits of digital development. To this end, it is necessary to proceed from the composite attributes of the elderly’s digital rights and interests, and construct a comprehensive legal guarantee system by improving special legislation, strengthening regulatory coordination, perfecting the diversified remedy mechanisms and enhancing the digital literacy of the elderly group. This system will realize the two-way empowerment of the high-quality development of the silver economy and the protection of the elderly’s digital rights and interests, and highlight the people’s livelihood warmth of Chinese-style modernization.
