Legal Protection for Preventing Safety Risks of Mutual-Aid Elderly Care “Time Banks”

摘要: “时间银行”的创建，不仅是应对我国人口老龄化国情的重要之举，更是为养老模式的创新提供了带头作用。广泛考察我国目前“时间银行”的试点实践后，能发现目前“时间银行”的运营中存在部分问题。本文剖析产生的法律与事实问题后，指出应当明确其在法律上应属于长期型志愿服务关系，同时提出了规范时间银行志愿服务协议签订，加强政府对时间银行的监督管理，推进个人信息保护法律制度适老化，保护服务提供者和接受者的合法权益这四个建议。

Abstract: The establishment of “time banks” is not only an important measure to respond to the national condition of population aging in China, but also plays a leading role in innovating elderly care models. After an extensive investigation into the current pilot practices of “time banks” in China, it can be found that there are some problems in their operation. After analyzing the resulting legal and factual issues, this paper points out that “time banks” should be clearly defined as a long-term voluntary service relationship in law, and puts forward four suggestions: regulating the signing of voluntary service agreements for time banks, strengthening government supervision and administration over time banks, advancing the aging-appropriate transformation of legal systems for personal information protection, and safeguarding the legitimate rights and interests of both service providers and recipients.
