Legal Governance of Intellectual Property Risks in Cross-Border E-Commerce: Practical Challenges, Institutional Dilemmas, and Systematic Responses

摘要: 跨境电商的迅猛发展带来了前所未有的知识产权保护挑战。本文旨在系统分析跨境电商活动中知识产权风险的现实表征、法律根源与治理难题。研究指出，风险已从单一的商品侵权演变为贯穿研发、销售、救济全流程的复合型风险。核心法律困境集中于平台责任认定中“通知–删除”规则与“应知”标准的适用模糊、国内监管规则与境外司法实践的激烈冲突。为应对挑战，我国应构建“企业合规为基础、平台治理为枢纽、行业引导为支撑、政府协调为后盾”的协同治理体系，并通过完善国内立法、参与规则制定、创新救济机制等方式，在开放与发展中寻求知识产权保护的最佳平衡。

Abstract: The rapid development of cross-border e-commerce has brought unprecedented challenges to intellectual property protection. This paper aims to systematically analyze the practical manifestations, legal roots, and governance difficulties of intellectual property risks in cross-border e-commerce activities. The study points out that the risks have evolved from single product infringement to complex risks spanning the entire process of research and development, sales, and remedies. The core legal dilemma focuses on the ambiguity in applying the “notice-and-take-down” rule and the “should-know” standard in determining platform liability, as well as the intense conflict between domestic regulatory rules and foreign judicial practices. To address these challenges, China should establish a collaborative governance system based on “enterprise compliance as the foundation, platform governance as the hub, industry guidance as support, and government coordination as a backing”, and seek the optimal balance of intellectual property protection in openness and development through improving domestic legislation, participating in rule-making, and innovating remedy mechanisms.
