On the Protection of Intellectual Property Rights for Computer Software

摘要: 本文围绕计算机软件知识产权保护展开研究，阐述计算机软件的概念、核心特征，以及对其保护具有激励创新、维护市场秩序、保障安全与对接国际规则的必要性。通过分析著作权法、专利法、商业秘密法三种保护模式的适用场景与局限，指出我国存在法律体系不健全、公众与企业保护意识薄弱、著作权侵权判定标准模糊、中小软件企业发展困境等问题，并从健全法律体系、强化意识培养、明确司法规则、扶持中小企业四方面提出对策，旨在完善软件知识产权保护体系，为推动我国软件产业高质量发展、提升国际竞争力提供切实思路。

Abstract: This article focuses on the research of intellectual property protection for computer software, elaborating on the concept and core characteristics of computer software, as well as the necessity of protecting it to stimulate innovation, maintain market order, ensure security and align with international rules. By analyzing the applicable scenarios and limitations of three protection models—copyright law, patent law, and trade secret law, it points out that there are issues such as an incomplete legal system, weak protection awareness among the public and enterprises, ambiguous standards for determining copyright infringement, and difficulties for small and medium-sized software enterprises in development in China. It then proposes countermeasures from four aspects: improving the legal system, strengthening awareness cultivation, clarifying judicial rules, and supporting small and medium-sized enterprises, aiming to perfect the software intellectual property protection system and provide practical ideas for promoting the high-quality development of China’s software industry and enhancing its international competitiveness.
