法律术语翻译策略浅析

A Brief Analysis of Translation Strategies for Legal Terminologies

摘要: 在我国对外开放持续深化、国际法律往来日益密切的背景下，法律翻译作为法律文明互鉴的核心载体，直接关乎跨语言、跨文化法律学术交流的成效，而法律术语翻译是法律翻译的重中之重。本文以法律术语为研究对象，系统解析其专业性、语义精确性与保守性三大核心特征，多维剖析语言差异、法律文化隔阂及译名不一致等关键影响因素。研究旨在完善法律术语翻译路径，提出语境适配、权威溯源与素养强化三大策略，在此基础上，本文聚焦英语专业学生的法律翻译学习路径，强调术语翻译不能止于词典对应，而须嵌入制度比较与概念溯源之中。针对“素养强化是长期过程”的现实困境，本文提出“法律术语翻译即时解决四步法”——术语定位、权威溯源、概念辨析、快速验证，旨在将长期积累拆解为可操作的方法论，实现任务驱动下的素养提升。

Abstract: Amid China’s deepening opening-up and increasing international legal exchanges, legal translation is crucial for effective cross-linguistic and cross-cultural academic communication, with legal term translation being particularly important. This study examines legal terms, analyzing their professionalism, semantic precision, and conservatism, and explores key factors such as linguistic differences, legal and cultural gaps, and terminology inconsistencies. It proposes three strategies—contextual adaptation, authoritative tracing, and competence enhancement—and emphasizes that term translation should extend beyond dictionary equivalence to comparative institutional and conceptual analysis. To address the long-term nature of competence development, the study introduces a “Four-Step Immediate Solution”—term identification, authoritative tracing, conceptual analysis, and rapid verification—offering a practical, task-driven methodology for improving translation proficiency.
