新就业形态下女性从业者劳动权益保护研究
Research on the Protection of Labor Rights for Female Workers in New Employment Forms
摘要: 新就业形态的蓬勃发展,既为女性从业者带来了前所未有的机遇,又对女性从业者的劳动权益保护带来了新的挑战。本文探讨了新就业形态下女性从业者劳动权益保护的现状,并且在此基础上分析新就业形态下女性从业者劳动权益保护存在的问题,如存在隐形性别歧视、女性“四期”保护难以落实、职业发展受限以及存在维权困境等。在此基础上,探讨这些问题背后的成因,并提出了新就业形态下女性从业者劳动权益保护的创新进路。
Abstract: The rapid growth of new employment models has brought unprecedented opportunities for female workers while also posing new challenges to the protection of their labor rights. This paper examines the current state of labor rights protection for female workers in new employment forms. Building on this foundation, it analyzes existing problems in safeguarding their rights, such as hidden gender discrimination, difficulties in implementing protections for women during pregnancy, menstruation, postpartum recovery, and lactation, limited career advancement opportunities, and challenges in asserting their rights. Furthermore, it explores the underlying causes of these issues and proposes innovative approaches to protecting the labor rights of female workers in new employment forms.
