老龄化趋势下老年人司法救济可及性问题探析

Exploration into the Accessibility of Judicial Relief for the Elderly in the Context of Aging Trend

摘要: 在人口老龄化进程加快背景下，老年人司法救济可及性问题日益明显。当前老年人在寻求司法救济过程中面临三重困境：意识层面存在法律认知不足与诉讼畏惧心理；制度层面遭遇司法服务供给与特殊需求的错位；保障层面面临法律援助覆盖有限、跨部门协作不畅等短板。提升老年人司法救济可及性，需要强化意识引导，通过精准普法与诉讼服务帮助老年人跨越认知障碍；推进涉老司法服务适老化改造，在场所设施、程序运行、审判机制等方面消除参与障碍；完善配套保障，优化法律援助与司法救助，构建跨部门协作网络，强化涉老案件执行力度。

Abstract: Against the backdrop of an accelerating population aging process, the issue of accessibility to judicial relief for the elderly has become increasingly evident. Currently, elderly individuals face threefold difficulties in seeking judicial relief: at the awareness level, there is a lack of legal knowledge and a fear of litigation; at the institutional level, there is a mismatch between the supply of judicial services and special needs; and at the protection level, there are shortcomings such as limited legal aid coverage and poor cross-departmental collaboration. To enhance the accessibility of judicial relief for the elderly, it is necessary to strengthen awareness guidance, assisting the elderly in overcoming cognitive barriers through precise legal education and litigation services; promote the aging-friendly transformation of judicial services related to the elderly, eliminating barriers to participation in terms of facilities, procedural operations, and judicial mechanisms; improve supporting safeguards, optimize legal aid and judicial assistance, build a cross-departmental collaboration network, and strengthen the enforcement of cases involving the elderly.
