老龄化社会中社区养老服务的行政监管问题探析

Exploration of Administrative Supervision Issues in Community Elderly Care Services in Aging Society

摘要: 社区养老作为养老服务体系的重要部分，对保障老年群体权益具有重要的意义。随着老龄化社会发展，我国社区养老服务种类越来越多，这虽然为老年人提供了更多的养老服务选择，但也给行政监管带来了难题，如在行政监管法律体系不完善、主体权责界定模糊、监管标准不统一、法律救济机制缺失等，这对我国养老服务体系的发展产生了影响。针对这些问题，文章提出完善法律体系、明确权责划分、统一监管标准、健全救济机制等对策，希望研究助力社区层面构建更加完善的养老服务监管体系，切实维护老年群体的合法权益。

Abstract: As an important part of the elderly care service system, community-based elderly care is of great significance in safeguarding the rights and interests of the elderly population. With the development of an aging society, the types of community-based elderly care services in China are becoming increasingly diverse. While this provides more choices for elderly care services for the elderly, it also poses challenges for administrative supervision, such as an imperfect legal system for administrative supervision, unclear definition of subject rights and responsibilities, inconsistent supervision standards, and a lack of legal relief mechanisms. These issues have an impact on the development of China’s elderly care service system. In response to these problems, the article proposes countermeasures such as improving the legal system, clarifying the division of rights and responsibilities, unifying supervision standards, and strengthening relief mechanisms. It is hoped that this research will help build a more comprehensive supervision system for elderly care services at the community level and effectively safeguard the legitimate rights and interests of the elderly population.
