论我国电商平台“二选一”行为法律规制研究

Research on the Legal Regulation of the “Exclusive Dealing” Behavior of E-Commerce Platforms in China

摘要: 随着互联网技术的飞速发展，电子商务平台在我国经济体系中扮演着日益重要的角色。然而，部分电商平台实施的“二选一”行为，极大扰乱了市场良性竞争环境，侵害了商家、消费者的正当权益，同时也对社会公共利益造成了损害。本文通过阐述电商平台“二选一”行为的基础理论，剖析其行为对经营者、消费者及竞争市场的影响，检视我国现有法律框架在约束此类行为时存在的不足，提出完善我国电商平台“二选一”行为法律规制的具体建议，以期维护公平、有序、健康的电商市场竞争环境，促进电子商务行业的可持续发展。

Abstract: With the rapid development of Internet technology, e-commerce platforms are playing an increasingly important role in China’s economic system. However, the “exclusive dealing” behavior implemented by some e-commerce platforms has greatly disrupted the benign competitive environment of the market, infringed upon the legitimate rights and interests of merchants and consumers, and also caused damage to public interests. This article elaborates on the basic theory of the “exclusive dealing” behavior of e-commerce platforms, analyzes its impact on operators, consumers and the competitive market, examines the deficiencies in the existing legal framework in China in regulating such behavior, and puts forward specific suggestions for improving the legal regulation of the “exclusive dealing” behavior of e-commerce platforms in China, with the aim of maintaining a fair, orderly and healthy competitive environment in the e-commerce market and promoting the sustainable development of the e-commerce industry.
