论我国三支柱养老金投资管理受信人义务的分层构造与统合

On the Layered Structure and Integration of Fiduciary Duties in the Investment Management of China’s Three-Pillar Pension System

摘要: 我国已经进入中度老龄化社会，养老金资金流庞大，作为人民民生福祉的重要保障，如何在我国当前养老金多层委托的管理体制构架下维护养老金安全成为应当讨论的重要问题。本文从我国养老金管理制度中分别拆解出三支柱养老金管理模式中的法律关系，通过分析整理我国养老金投资管理法律关系中的共性问题与特殊化困境，引入信义关系理论与信义义务，并根据我国国情制度实际，有针对性地提出信义义务的适用方案。

Abstract: China has entered a moderately aging society, with a huge flow of pension funds. As an important guarantee for people’s livelihood and well-being, how to maintain the security of pension funds under the current multi-level entrusted management system framework in China has become an important issue to be discussed. This article dissects the legal relationships in the three-pillar pension management model from China’s pension management system, analyzes and sorts out the common problems and special difficulties in the legal relationships of pension investment management in China, introduces the fiduciary relationship theory and fiduciary duties, and based on the actual national conditions and systems of China, proposes applicable solutions for fiduciary duties in a targeted manner.
