行政失信惩戒与行政处罚的界分
The Distinction between Administrative Dishonesty Punishment and Administrative Penalty
摘要: 我国社会信用体系建设中,失信惩戒机制广泛推行,但“失信”概念模糊、规制缺失等问题引发法治疑虑。本文以《行政处罚法》为基础,提出行政处罚的识别标准为方式制裁性、对象违法性与目的报应性。据此检视与行政处罚最为类似的行政失信惩戒,得出受益限制类、加强监管类、推送相关主体参考类无制裁性;资格限制类、负面信息类虽具有制裁外观,但针对失信状态而非特定违法,且目的在于风险防范;仅行为限制类中针对不依法服兵役的失信惩戒符合行政处罚特征。行政失信惩戒与行政处罚二者的本质差异在于前者是状态管控、后者是违法制裁,需通过细化立法、完善程序与救济机制,构建专属于行政失信惩戒的法治规制路径。
Abstract: In the construction of China’s social credit system, the dishonesty punishment mechanism has been widely implemented. However, problems such as the vague concept of “dishonesty” and inadequate regulation have raised rule-of-law concerns. Based on the Law on Administrative Penalties, this paper puts forward the identification criteria for administrative penalties: sanctionability in method, illegality of the object, and retributiveness in purpose. Against these criteria, administrative dishonesty punishment, which is most similar to administrative penalties, is examined. It is concluded that benefit restriction, enhanced supervision, and reference provision to relevant entities are non-sanctioning. Although qualification restriction and negative information disclosure appear punitive, they target a state of dishonesty rather than specific violations and aim at risk prevention. Only the dishonesty punishment targeting refusal to perform military service in accordance with the law within the category of conduct restriction conforms to the characteristics of administrative penalties. The essential difference between administrative dishonesty punishment and administrative penalties lies in that the former is state control while the latter is illegal sanction. It is necessary to construct a exclusive rule-of-law regulation path for administrative dishonesty punishment by refining legislation and improving procedural and remedy mechanisms.
