Conflicts and Coordination between Personal Information Rights and Interests and the Right to Privacy in the Context of AI Algorithmic Recommendation

摘要: 算法推荐已成为数字经济的核心商业模式，其全维度无感追踪、黑箱式决策、聚合式私密信息生成的技术特征，突破了传统人格权保护的制度预设，导致《民法典》明确界分的隐私权与个人信息权益，在该场景下出现客体边界模糊、权能行使冲突、责任认定困难的困境。本文以算法推荐场景的法律独特性为逻辑起点，系统剖析两项人格权益的冲突样态，构建动态分层客体认定、双重同意行权保障、适配性责任规则的全链条协调路径。本文研究可为司法裁判提供统一的适用标准，实现人格权全面保护与数字经济健康发展的动态平衡。

Abstract: Algorithmic recommendation has become a core business model of the digital economy. Its technical features, including omnidimensional non-perceptive tracking, black-box decision-making, and aggregated generation of private information, have broken through the institutional presuppositions of traditional personality right protection. This has led to dilemmas such as blurred object boundaries, conflicts in the exercise of statutory powers, and difficulties in liability determination between the right to privacy and personal information rights and interests—two rights clearly demarcated in the Civil Code of the People’s Republic of China—within the algorithmic recommendation context. Taking the legal uniqueness of the algorithmic recommendation scenario as its logical starting point, this paper systematically analyzes the conflict patterns of the two personality-related rights and interests, and constructs a full-chain coordination path covering dynamic and hierarchical object identification, a dual-consent mechanism to safeguard the exercise of rights, and tailored liability rules. The findings of this paper can provide a unified application standard for judicial adjudication, and realize the dynamic balance between the comprehensive protection of personality rights and the sound development of the digital economy.
