Legal Regulation in the Intelligentization of High-Speed Rail

摘要: 随着一代又一代的新型高铁投放使用，我国的高速铁路技术在国际取得瞩目成绩。同时，数字时代的快速发展也带来一系列的问题，聚焦于铁路运输领域最为重要的就是对个人信息的保护问题。在个人信息受到严重威胁的今天，讨论如何在铁路运输领域加强法律规制对隐私权进行保护。如今的个人信息不仅具有其独有的特殊性还具有涉及主体的广泛性和财产性。在明确责任主体的情况下，总结了我国法律保护铁路乘客信息的现状，但仍是存在立法碎片化、分散化且内容不明确等情况，也存在规则标准不明确和同意原则滥用的情况。要明确以《中华人民共和国铁路法》为核心，围绕其建立完善的法律规范体系，切实落实保护乘客客人信息的目的。

Abstract: With the deployment of new high-speed rail generations, China’s high-speed rail technology has achieved remarkable international recognition. Meanwhile, the rapid advancement of the digital era has also brought a series of challenges, with the most critical issue in the railway transportation sector being the protection of personal information. In an era where personal information faces severe threats, discussions on how to strengthen legal regulations in railway transportation to safeguard privacy rights are essential. Today’s personal information not only possesses unique characteristics but also involves a wide range of subjects and has financial implications. Under the premise of clarifying responsible entities, this study summarizes the current state of legal protection for railway passenger information in China. However, issues such as fragmented and decentralized legislation, ambiguous content, unclear regulatory standards, and the misuse of the consent principle persist. It is imperative to establish a comprehensive legal framework centered on the Railway Law of the People’s Republic of China, effectively achieving the goal of protecting passenger information.
