Litigation Rights Protection for the Elderly in Smart Courts Amid Population Aging

摘要: 伴随我国人口深度老龄化与智慧法院建设的持续深化，数字鸿沟导致的老年群体诉讼权利保障问题日益凸显。本文以数字鸿沟理论为分析框架，梳理了老年群体在智慧诉讼全流程面临的现实困境，从个体、技术、制度三重维度剖析了困境的生成逻辑，提出以理念革新、技术适配、制度完善为核心的包容性智慧诉讼制度优化路径，为完善涉老司法保障体系、实现司法实质平等提供参考。

Abstract: Against the backdrop of the profound aging of China’s population and the sustained in-depth advancement of smart court development, the issue of safeguarding the litigation rights of the elderly arising from the digital divide has become increasingly prominent. Taking the theory of digital divide as its analytical framework, this paper sorts out the practical dilemmas faced by the elderly throughout the entire process of smart litigation, dissects the formation mechanism of these dilemmas from the three dimensions of individual, technological and institutional factors, and proposes an optimization path for an inclusive smart litigation system centered on conceptual innovation, technological adaptation and institutional improvement. This study aims to provide a reference for improving the judicial security system for the elderly and realizing substantive equality in the administration of justice.
