摘要: 本文聚焦于在建船舶抵押融资的法律问题，通过对在建船舶抵押融资的内涵、特点、法律渊源等基础理论的分析，结合我国相关法律规定及实践中的案例，深入探讨在建船舶抵押权的设立、效力、实现方式以及风险防范等关键法律问题。研究发现，我国在建船舶抵押融资在法律层面存在所有权归属不明确、抵押权实现困难、登记制度不完善等问题，这些问题影响了在建船舶抵押融资业务的发展。为此，提出完善相关法律规定、明确所有权归属、优化抵押权实现方式、健全登记制度等建议，以促进在建船舶抵押融资市场的规范化和可持续发展。

Abstract: This paper focuses on the legal issues surrounding the mortgage financing of ships under construction. By analyzing foundational theories—including the concept, characteristics, and legal sources—and examining relevant Chinese laws and practical cases, it deeply explores key legal aspects such as the establishment, validity, realization, and risk prevention of mortgages on ships under construction. The study reveals that the current legal framework in China suffers from unclear ownership attribution, difficulties in realizing mortgage rights, and an imperfect registration system, all of which hinder the healthy development of this financing sector. Accordingly, the paper proposes suggestions to improve relevant laws, clarify ownership, optimize the realization of mortgage rights, and perfect the registration system, aiming to promote the standardization and sustainable development of the market for mortgage financing of ships under construction.
