Legal Protection of the Digital Consumption Rights and Interests of the Elderly

摘要: 在银发经济与科技迅速发展的背景下，我国老年人数字消费规模不断扩大，但受老年人数字素养不足、平台责任缺失、监管体系不健全等因素影响，老年群体在数字消费中面对虚假宣传、价格欺诈、预付式消费风险等问题时，权益受损现象频发。需立足银发经济发展背景，系统分析老年人数字消费的发展现状与权益受损表现，梳理现行法律保障体系及其在司法实践中面临的困境。在此基础上，应从立法、执法、司法、守法四个维度提出法律完善路径，旨在构建系统化的老年人数字消费权益的法律保障体系，助力银发经济高质量发展。

Abstract: With the rapid advancement of the silver economy and digital technology, digital consumption among the elderly in China has continued to expand. However, influenced by factors such as the insufficient digital literacy of the elderly, the lack of platform accountability, and the inadequacy of the regulatory framework, frequent infringements of the rights of the elderly occur in digital consumption when they are confronted with issues including false advertising, price fraud, and risks associated with prepaid consumption. It is necessary to systematically analyze the current state of digital consumption among the elderly and the manifestations of such rights infringements, and to examine the existing legal protection framework and the challenges it faces in judicial practice. On this basis, pathways for legal improvement should be proposed from the four dimensions of legislation, enforcement, adjudication, and compliance, with the aim of establishing a systematic legal protection system for the digital consumption rights of the elderly and promoting the high-quality development of the silver economy.
