人工智能生成物的可版权性问题研究
Research on the Copyright Issues of Artificial Intelligence Products
摘要: 人工智能技术的迅猛发展深刻冲击着传统版权法的既有框架。人工智能生成物能否纳入版权法保护体系,已成为知识产权法学研究中的重要议题。围绕这一问题,学界争议主要集中于三个维度:其一,人工智能能否取得版权主体地位;其二,人工智能生成物能否满足独创性要件;其三,相应权利应当如何归属。在现行著作权法体系下,人工智能生成物因欠缺自然人的201c创造性201d要素,难以直接认定为著作权法意义上的作品。然而,考量人工智能生成物所具备的经济价值与传播价值,立法政策上亟须予以回应。本文在梳理各方学说的基础上,认为将人工智能生成物纳入邻接权保护体系,是在维护现行著作权法体系稳定性前提下保护相关主体合法权益的可行路径,并就具体制度构建提出了初步设想。
Abstract: The rapid development of artificial intelligence technology has a profound impact on the existing framework of traditional copyright law. Whether artificial intelligence products can be included in the protection system of copyright law has become an important topic in the study of intellectual property law. Around this issue, academic disputes mainly focus on three dimensions: First, whether artificial intelligence can obtain the status of copyright subject; second, whether the products of artificial intelligence can meet the requirements of originality; third, how should the corresponding rights belong? Under the current copyright law system, it is difficult for artificial intelligence products to be directly recognized as works in the sense of copyright law because of the lack of 201c and 201d elements of natural persons. However, considering the economic value and communication value of artificial intelligence products, it is urgent to respond in legislation and policy. On the basis of combing the theories of various parties, this paper holds that it is a feasible way to protect the legitimate rights and interests of relevant subjects on the premise of maintaining the stability of the current copyright law system by bringing artificial intelligence products into the neighboring rights protection system, and puts forward some preliminary ideas on the construction of specific systems.
