人工智能生成发明的创造性标准问题研究
Research on the Creativity Standard of Inventions Generated by Artificial Intelligence
摘要: 人工智能作为一款强大的工具在当下已经成为很多发明人辅助发明的助手,随着其发明能力的增强,角色转变逐渐发生。当前,人工智能已具备自主生成发明成果的能力,这给专利制度中的创造性判断标准带来了挑战。实践经验显示,若继续沿用现行创造性审查标准,并不会阻碍人工智能生成发明获得专利授权,这一现状极易导致大量低质量专利涌入保护范畴。因此,为实现对不同主体生成发明的规制,有必要为人工智能生成发明与人类自主发明分别构建差异化的创造性判断体系。在具体审查实践中,应通过适当拓宽现有技术的检索范围、提高本领域技术人员的技术水平界定标准、严格把控非显而易见性的判断尺度等方式,主动适配人工智能技术发展引发的专利制度变革需求,确保专利授权的质量与专利制度的核心价值。
Abstract: Artificial intelligence, as a powerful tool, has become an assistant for many inventors to assist in invention. With the enhancement of its invention ability, the role transformation is gradually taking place. Currently, artificial intelligence has the ability to independently generate invention results, which poses a serious challenge to the creative judgment criteria in the patent system. Practical experience has shown that if the current creative examination standards continue to be used, it will not hinder AI generated inventions from obtaining patent authorization. This situation can easily lead to a large number of low-quality patents entering the scope of protection. Therefore, in order to achieve scientific regulation of inventions generated by different entities, it is necessary to construct differentiated creative judgment systems for AI generated inventions and human independent inventions. In specific examination practices, it is necessary to actively adapt to the needs of patent system reform triggered by the development of artificial intelligence technology by appropriately expanding the search scope of existing technology, improving the technical level definition standards of technical personnel in this field, and strictly controlling the judgment scale of non obviousness, to ensure the quality of patent authorization and the core value of the patent system.
