高等教育治理法治化的困境与路径探析

On the Dilemmas and Paths of the Rule of Law in Higher Education Governance

摘要: 在全球高等教育治理范式转型的宏观背景下，高等教育治理法治化成为深化高等教育领域综合改革、实现高等教育内涵式发展的必然要求。其现行法律基础是一个以宪法为根本、以《教育法》为基本遵循、以《高等教育法》为核心，涵盖专项法律、行政法规、部门规章及高校章程的多层级规范体系。本研究整合运用文献分析法、比较研究法与案例研究法，以理论梳理与现状分析为基础，对高等教育治理法治化的核心概念与理论基础进行系统界定与阐释，并据此明确其价值目标与基本原则。以期为解决高等教育治理中的实际困境、促进高等教育事业健康发展提供理论支持与实践支撑。

Abstract: Against the macro background of the transformation of the global higher education governance paradigm, the legalization of higher education governance has become an inevitable requirement for deepening the comprehensive reform in the field of higher education and realizing the connotative development of higher education. Its current legal foundation is a multi-level normative system with the Constitution as the fundamental basis, the Education Law as the basic guideline, the Higher Education Law as the core, covering special laws, administrative regulations, departmental rules and university charters. This study integrates the use of literature analysis method, comparative study method and case study method. Based on theoretical combing and current situation analysis, it systematically defines and explains the core concepts and theoretical basis of the legalization of higher education governance, and clarifies its value objectives and basic principles accordingly. It is expected to provide theoretical support and practical support for solving the actual dilemmas in higher education governance and promoting the healthy development of higher education.
