积极老龄化背景下老年人再就业法律权益保障研究

Active Aging Context: A Study on the Legal Protection of the Rights and Interests of the Elderly in Re-Employment

摘要: 随着我国人口老龄化进程加速，积极老龄化战略的提出为老年人再就业创造了新的政策环境。然而，当前我国老年人再就业法律权益保障面临法律定位模糊、制度供给不足、权益救济困难等现实困境。本文在分析老年人再就业法律权益保障现状的基础上，提出应明确老年人再就业的法律地位，构建多层次的法律保障体系，完善劳动争议解决机制，以期为积极老龄化战略的实施提供法治支撑。

Abstract: As the process of population aging accelerates in China, the introduction of the active aging strategy has created a new policy environment for the re-employment of the elderly. However, the current legal protection of the rights and interests of the elderly in re-employment in China faces practical dilemmas, including ambiguous legal status, insufficient institutional supply, and difficulties in rights relief. Based on an analysis of the current situation regarding the legal protection of the rights and interests of the elderly in re-employment, this paper proposes clarifying the legal status of the elderly in re-employment, constructing a multi-layered legal protection system, and improving the dispute resolution mechanism, aiming to provide legal support for the implementation of the active aging strategy.
